In this case, the plaintiff slipped and fell over food and wrappers that had been dropped or discarded onto a stairway within the Port Authority building during rush hour. The plaintiff in this case wisely obtained the name and telephone number of someone who witnessed the accident, who also provided an affidavit that the stairway had continual litter problems for months before the accident. This affidavit saved plaintiff's case from being dismissed by the Court, and allowed plaintiff to achieve a settlement that not only paid off her medical liens, but also gave her additional money to compensate for her pain and suffering.
