Plaintiff, then a 62 year-old woman, was walking with her daughter near the Jacob Javits playground by Fort Hamilton Avenue in Manhattan at approximately 11:00 p.m. when she tripped and fell over a raised portion of sidewalk, fracturing her wrist. Although the City of New York initially denied the plaintiff's personal injury accident claim, our investigation revealed that the City's Department of Transportation was previously aware of the defective sidewalk in that specific area, yet negligently failed to correct the problem.
