On Wednesday, September 15, a 75 year-old Queens man was killed when a van crashed into an FDNY ambulance, and then flipped over and into this pedestrian, at the intersections of Woodside Avenue and 76th Street in Woodside.
Although tpolice were still investigating the cause for the multi-vehicle accident, chances are that the ambulance driver will not be held responsible for the accident under New York law. The reason?
Because under New York law, an ambulance that is responding to a call will not be held liable absent recklessness.
