After the On the Avenue Hotel's staff urged the plaintiff to try to get out of a disabled elevator in their establishment on his own - rather than getting him appropriate help - the plaintiff slipped and fell down the elevator shaft, causing him permanent damages to his leg, which may require a surgical amputation. As a result, the hotel conceded liability, i.e., admitted it was at fault and responsible for the New York elevator accident, and agreed to pay an $8.5 million settlement of the claim..
