Macy's Sues Martha Stewart Living in NY for Breach of Contract
Lest anyone think that only individuals or comparatively "small" companies have their agreements broken, a lawsuit filed yesterday in New York Supreme Court by department store giant Macy's suggests otherwise.
Although the initial documents were apparently filed under seal, a report in the Washington Post indicates that Macy's sued to block a proposed deal between Martha Stewart Living and J.C. Penney, as the terms of that deal would inherently violate Martha Stewart's earlier agreement that gave Macy's the exclusive right to sell Martha Stewart living products in their stores.
At present, it does not appear that Martha Stewart has filed any responsive pleadings, but given the parties' past legal track record, I would not be surprised in the slightest if this breach of contract case takes a significant amount of time to resolve.
