Following extensive motion practice, the claims against our client sounding in trespass, intentional infliction of emotional distress, wrongful death and negligence against our client were dismissed on jurisdictional grounds. Given the strength of the defenses presented to the Federal Court in the Southern District of New York, the plaintiffs have declined to appeal the Court's ruling.
