After much saber-rattling by our client's former employer surrounding his departure under less-than-ideal circumstances (our client was loudly berated and demeaned by his supervisor, and was told to leave), the former employer insisted that he was not, in fact, terminated, and was therefore still bound by the non-compete he signed years earlier.
They then threatened to come after him if he violated the restrictive covenant. Instead, the former employer ended up paying our client to walk away short of filing suit, as he was owed unpaid salary and commissions - and - importantly - without litigation.
