If I was a passenger in my spouse's car and he got into a two-car accident with another vehicle, can I also sue my spouse in order to try and recover damages under our own auto insurance policy - in addition to the other driver's policy?

Strange as it may sound, the answer is yes. Under New York's General Obligations Law, you can sue your spouse for your personal injuries that were sustained in a car accident in New York.
