If I was a passenger in my spouse's car and he got into a two-car accident with another vehicle, can I also sue my spouse in order to try and recover damages under our own auto insurance policy - in addition to the other driver's policy?

Strange as it may sound, the answer is yes. Under New York's General Obligations Law, you can sue your spouse for your personal injuries that were sustained in a car accident in New York.

For more information about what steps you should take in the event of a car crash, please download a FREE copy of our ebook entitled "Why Most Accident Victims Do Not Recover the Full Value of Their Claim" here, which is written by New York, Queens and Nassau Accident Attorney Jonathan Cooper.
