Although our client conceded at his deposition that he was not aware of any prior complaints or incidents involving the subject elevator, and the defendant's records failed to reveal any prior incidents demonstrating that they knew or should have known that the elevator door was defective, we were able to convince the defendant's insurer to settle this case, and we were also able to convince our client's workers' compensation carrier to waive the vast majority of their lien (which exceeded $20,000) to settle this case.
