Our client, who was a passenger in a yellow cab, that was rear-ended by a truck in the busy streets of midtown Manhattan. As a result of the impact, our client suffered an injury to her neck, which ultimately required a diskectomy. Although she was not wearing her seat belt at the time of the accident, and despite the truck driver's insurance carrier's position disclaiming coverage for the accident, we were able to convince the truck driver's insurance carrier that their disclaimer would not prevail, and to pay this sum in settlement of the action following a pre-trial mediation.
