Can a construction worker recover damages for his personal injuries that were sustained when he trips over a cinder block at a worksite under New York law?


According to a recent opinion by a trial court in New York County, the answer is yes - assuming it was left out and not properly secured. And the reason is that a cinder block is considered a construction site related hazard.
