If my employee tries to solicit my customers after he leaves his job, can I recover damages for breach of fiduciary duty if he succeeds in luring away my customers?

A:
As noted in our blog post, Defiing Breach of a Fiduciary Duty, unless you had a specific agreement that barred your former employee from soliciting your customers post-termination, the answer is probably not.
