It depends on a number of factors, but the most important is where your case is venued, as there is currently a dispute between the Courts in New York State. If your case was brought in either New York or Bronx counties, the Court is more likely to accept these reports; if your case was brought in one of the Courts of the Appellate Division, Second Department, however (e.g., Brooklyn, Staten Island, Nassau, Suffolk or Westchester counties), there is a strong likelihood that the court will not accept into evidence these records.
